If: (1) it has sufficient capacity for the retention on board of all garbage while operating in the area; and
(2) it has made arrangements for the discharge of retained garbage at a reception facility after leaving the area. It must also hold an entry permit issued under Section 5 of the Antarctic Act 1994 (although a permit is not required for a ship in transit through the high seas of Antarctica to an immediate destination outside Antarctica). , is not deemed by the shipping company and the ship's master as sufficient to protect against acts of piracy; and (3) the use of armed guards is assessed to reduce the risk to the lives and wellbeing of those on-board the ship.
