It has been described by a judge as: "The omission to do something which a reasonable man....would do, or doing something which a prudent and reasonable man would not do". Negligence is committed whenever a person owing a legal duty of care to another person breaches his duty with the result that damage of some kind (e. g. physical or financial) is caused to the other person. Negligence is the biggest area of tort law litigation.
